Terms and Conditions

Wherever used herein, the term “equipment” and/or “ebike” and/or “bike” and/or “electric bike” and/or “rental” and/or “bicycle” shall include any equipment rented from Black Hills Power Bikes LLC. Wherever used herein, the term “customer” and/or “client” and/or “renter” and/or “participant” and/or “he/she” shall include all customers receiving any service that Black Hills Power Bikes LLC. provides. Any information provided to/from Black Hills Power Bikes LLC. on the booking reservation or any other correspondence to Black Hills Power Bikes LLC. applies to this contract.  Black Hills Power Bikes LLC, its agents, servants, and employees shall not be responsible for personal injuries or property damage, loss or delay incurred by any person arising out of the act of negligence of any direct or supplemental carrier or other person rendering any of the services or products being offered in these rentals; nor shall Black Hills Power Bikes LLC. be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the actual control of Black Hills Power Bikes LLC., or of any agent or supplier, or due to force majeure. Renters follow any suggested itinerary and recommendations at their own risk and agree not to hold Black Hills Power Bikes LLC. responsible for injury or death resulting from accidents. We strongly recommend the use of approved helmets whenever mounted on a bicycle.  Helmets are available to rent. The bicycles provided for use are in satisfactory operating condition and participants agree to use them at their own risk or call deficiencies to the attention of a company representative. ​Individual bike specifications are subject to change based on availability of replacement components. Instruction in the use, assembly and maintenance of bicycles will not be provided and participants affirm that they are competent and familiar with the use of a multi-speed electric bicycle.

Rental pick up times, return times, and transportation of the bicycles are subject to approval by management at Black Hills Power Bikes LLC. The rental pick-up and return location should have a staffed reception available during your specific pick-up time and return time that is stated on the reservation and will have local contact phone number available. Customers are responsible for collecting their bicycles and returning the bicycles at the specific pick-up time and specific return time that is stated on the reservation. We recommend if a customer is transporting the bicycles to another location, he/she use a reputable shuttle service in the area. The location and means of transportation are subject to approval by management at Black Hills Power Bikes LLC for any client choosing to transport the bicycles to another location. Customer agrees that he/she assumes all liability for the bicycles, despite mode of transportation. All bicycles and equipment are to be returned to Black Hills Power Bikes LLC. Located at 1029 Mt Rushmore Rd STE A, Custer SD 57730.


Although all our bikes are professionally serviced before dispatch, bicycles may need tuning or maintenance during the course of the rental period; such maintenance can be made with basic tool provided with each rental. Black Hills Power Bikes will cover the cost of damages due to equipment failures beyond the renters control; i.e. damage that occurs due to a manufacture defect or worn parts.  Any deficiencies must be communicated to Black Hills Power Bikes LLC. immediately upon receipt of the equipment.  To be eligible for a refund of service, customers must provide Black Hills Power Bikes LLC. with a photo of the damaged or worn parts or mechanical malfunction. Black Hills Power Bikes LLC. is responsible for structural deficiencies such as damaged frames, worn bottom brackets, suspension and wheel hubs.  Black Hills Power Bikes LLC. is not responsible for the following occurrences during bike rental:  
punctures / broken spokes / broken chains / broken derailleurs / broken drop-outs / wheel rim damage / torn saddles / stripped threads on pedal crank / damage beyond the control of Black Hills Power Bikes LLC. and resultant of customers use or misuse. 

If any customer is undertaking an unassisted bicycle tour, we strongly recommend that he/she have some basic bicycle maintenance knowledge. 

Customer agrees he/she will return the equipment in the same good condition as when received, ordinary wear and tear accepted, and to repair and replace lost or stolen, damaged or broken bicycles or parts or to reimburse Black Hills Power Bikes LLC. for said equipment. Therefore, regardless of the party at fault, customer understands and agrees to be responsible for the theft or damage to said equipment.

Customer understands and agrees that any subleasing of rental equipment is prohibited and that any such sublease shall immediately cause termination and cancellation of this contract.

Customer shall assume liability for any and all damage or loss of and to personal property, accident / injury to other persons related to said rental equipment.

We strongly recommend that customers always carry a personal or travel insurance policy.

Bike rental: Upon confirmation, full payment is requested at the time of booking per electric bike to secure your reservation. He/She will have thirty minutes during booking to pay in full or costumers’ reservation is subject to cancellation. 


We require 48 hours’ notice if customer need to cancel his/her reservation for a full refund or if reservation needs rescheduled. We cannot guarantee the days and times we have available to reschedule. No refunds will be given if customers reservation is canceled within 48 hours of his/her booked time. We are unable to give refunds if customers do not show up to his/her reservation. If customers show up late to his/her booked time, that time will be counted as part of his/her time block, the return time will remain the same. We are unable to offer refunds for inclement weather, or any circumstance out of Black Hills Power Bikes LLC.’s control. Please come prepared for inclement weather and plan accordingly.

If customers electric bike malfunctions due to mechanical problems, customers will be rescheduled or refunded. If customers electric bike malfunctions due to customer error, he/she will not be refunded and will be held responsible for any damages. 

All refunds are subject to a service fee of 5%.

Any applicable refunds will be issued upon return of all rented equipment.

We may require a damage deposit in the form of credit card charge plus the driver’s license / photo ID of one member of the party.  Any deposit given by the customer shall be applied to the balance and guarantee the faithful performance of all the provisions of this agreement and all repairs necessary to said equipment. If any action is brought to enforce any of the terms of conditions of this agreement, or to recover any sums due to hereunder, customer agrees to pay all legal fees, court costs, or other expenses.

An additional day’s rental fee of $175.00 will be charged as a late fee for any additional time past the scheduled return time specified on the booked reservation that applies to this contract. All equipment must be returned directly to Black Hills Power Bikes LLC. at 1029 Mt Rushmore Rd STE A, Custer SD, 57730. If the possibility exists that customer will be unable to return the rental at the specific return time stated on his/her reservation that applies to this contract, communication to management at Black Hills Power Bikes LLC. is required, the late fee will still apply. If no communication from customer is received after one hour of the specific return time stated on his/her reservation that applies to this contract, the equipment will be considered lost and/or stolen and the proper authorities will be notified.

Customer agrees that Black Hills Power Bikes LLC. has the right to terminate this agreement at any time and retake possession of said equipment and for said purpose Black Hills Power Bikes LLC. may enter upon the premises of the customer without becoming liable for trespass.
